Why mediate?
Going to court is expensive and uncertain. The only certainty with a court action is that the lawyers will walk away happy. You have no control over what the judge or jury will decide - they can be loony.
Arbitration is also scary, even though arbitration is way better than going to court. The problem with arbitration, again, is that somebody else makes the decisions.
With mediation, you are in control of the solution. You decide what you can and can't live with, you decide what's going to happen next.
Mediation is absolutely always the best choice.
If we don't reach a solution with mediation, you can always go the other routes. However, I have never had people fail to come to an acceptable resolution.
